Unpaid Overtime Still a Problem in Arizona Workplaces

Federal laws such as the Fair Labor Standards Act require that workers receive overtime pay for each hour worked over 40 in a single week. Still, unpaid overtime is a problem in workplaces across Arizona.

Make no mistake: you have a right to the wages you are owed, and failing to pay overtime wages is a form of employer misconduct.

Employees who work more than 40 hours in a week are typically entitled to overtime pay, which is 1.5 times the regular rate of pay.

In other words, if your regular pay rate is $10.50 an hour, the overtime rate would be $15.75 an hour.

As we discussed in a recent post, you are also entitled to overtime pay if you are a restaurant worker who works more than 40 hours in a week at two restaurants owned by the same employer.

Depending on the circumstances, you may have a number of options for receiving unpaid overtime.

At The Zoldan Law Group, we fight to help workers in Arizona get the overtime pay they deserve. Our attorneys advise and represent employees throughout the entire process of challenging employer wage violations, including:

  • Filing a letter of demand
  • Filing formal complaints
  • Negotiating with the employer
  • Taking the case to trial if necessary

Know your wage and hour rights. Arizona's minimum wage is increasing in 2017.

Arizona voters recently passed Proposition 206, which will raise the minimum wage to $10 an hour in 2017. The minimum wage will also increase to $12 an hour by 2020.
